Employment Disputes and
Compensation Awards
Employment Disputes - Provides legal
costs and expenses to:
- Negotiate on behalf of
the policyholder prior to the issue of legal proceedings
in a court or tribunal following dismissal of an employee
Defend legal proceedings arising
from disputes with employees or ex-employees relating to
their contract of employment
Defend legal proceedings
with employees, ex-employees or prospective employees
under legislation for unlawful discrimination on the
grounds of sex, race, disability or religious belief or
political opinion;
Appeal or defend an
appeal against sentence, conviction or judgment of the
relevant court or tribunal
DAS also pays costs awarded
against the policyholder in civil cases in respect of any
of the above
Compensation Awards
In respect of a claim we have
accepted under Employment Disputes cover, we will pay any basic
and compensatory award and/or compensation awards for unlawful
discrimination on the grounds of sex, race, disability, religious
belief or political opinion

Employment Disputes and Compensation
Awards does not cover:-
- any claim where
the policyholder has not followed reasonable
established procedures such as the ACAS Code of
Practice or DAS's advice;
additional or
special awards due to non-compliance with
tribunal orders

redundancy,
alleged redundancy or unfair selection for
redundancy (unless agreed in advance of dismissal
by DAS)

dismissals
due to trade union activities, membership or
non-membership
-
payment
of money due under a contract of employment
-
claims
by employees relating to personal injury or loss
of or damage to property
-
redundancy
matters arising within the first 180 days of the
first period of indemnity

claims
where the cause of action arises within the first
90 days of cover

claims
arising during the first 180 days of cover
involving an employee subject to a written or
verbal warning given at any time during the 180
days before inception of policy cover

SERVICE OCCUPANCY
- Negotiate for the
policyholder's legal rights against an employee or
ex-employee to recover possession of premises which are
owned or which are the responsibility of the policyholder

Defending the policyholder's legal
rights arising from action taken to recover possession of
premises which are owned or which are the responsibility
of the policyholder. |
TAX PROTECTION - Provides costs and
expenses to:
- Represent the
policyholder in an in-depth investigation or Full enquiry
by the Inland Revenue into the business
- Represent the policyholder in a
review by the Inland Revenue into the Policyholder's
compliance with PAYE regulations
- Represent the
policyholder in a dispute arising from the review of the
operation of the PAYE system following a PAYE audit
- Appeal against an
assessment issued by HM Customs and Excise in respect of
VAT due;

TAX
PROTECTION does not cover any investigation or enquiry
- deliberately
solicited by the policyholder
- caused by a
failure to register by VAT
- undertaken
by the Inland Revenue Special Investigation
section
- by
Customs and Excise into an alleged criminal
offence
